Albany NY Bail Bonds Agency

Hello, at Albany bail bondsmen .com We are here to help get your loved one, a family member or friend out of jail as soon as possible. This is why giving you the answers on how someone gets out of jail in New York State will help you understand and be better educated when deciding on which course of action to take. Here we will try to explain some basic facts about Albany jails and release options.

  • 1. Keep calm, nothing bad is going to happen to the accused while being detained.
  • 2. If you speak to the accused try to calm him or her down. Explain you are working on getting them out.
  • 3. Get as much information on where the person is being detained, the name of the jail or police station ETC.
  • 4. Bonds are set once the defendant has seen a judge. Once the court has set bail the defendant will be remanded to the local jail until bond is posted or the case is resolved.

You have two options for paying or securing a monetary bail.

1. You can pay the full amount in cash yourself by going directly to the jail or court and depositing the bail in cash. Or

2. You can pay a percentage of the bail, typically up to 10% of the bail amount for state cases and 15% for federal immigration bonds. Example: your loved one has seen a judge and the bail was set at $1,000.00 you can pay a bail bondsman 10% = $100.00 and sign a promise that the defendant will come back to court or you will be responsible for the full amount of the bail.

About the Albany jail and court system. Bonds are typically posted in the courthouse. After the bond is accepted the court official or clerk of court will have a release order sent to the detention facility. The jail booking officer will verify that the bond is in order and confirm the identity of the defendant to be released. Once all this is completed the defendant is released from custody and is free to go home.

Being arrested and brought at the county jail does not get better with time. Initially after the booking process is completed, defendants are transferred a holding cell until they have had the opportunity to go before a judge. This is called an arraignment. The judge may hear testimony from complainants and the arresting officer but in most cases the district attorney assigned to the case will read to the court a short version of the events that led to the charges filed against the accused. The court will then hear from your attorney or the public defender about your ties to the community, your prior arrest history if any and why you are entitled to bail. Your attorney will enter a not guilty plea on your behalf and request a speedy trial by jury.

U.S. Immigration laws are very complex and change frequently. If you are foreign and are arrested or make an error concerning your legal status in the United States, you could find
yourself being forced to leave the United States or worse you could be detained by Home Land Security and held at an INS detention facility while your legal status is corrected or you are deported. Pleading guilty for a felony. even a charge of spousal abuse or domestic violence could get you in trouble with the immigration authorities.
That is why it is critical that you know the United States immigration laws and comply with them. It is advisable that you consult with an immigration attorney before accepting a felony plea.

About bail bonds and forms of collateral.

A bail bond is a form of a guarantee that is given for the pre-trial release of an accused. Surety bonds as they are known promise that if the principal fails to show up at trial the obligor the "bail bondsman" will pay the full amount of the bail to the court. This is called a forfeiture of bond notice, basically it notifies the parties to the bond that the conditions of release have been breached and the court has ordered the bond monies forfeited.

About bond collateral.
Typically collateral is returned once the defendant has finished his or her case and no breach or forfeiture has been issued by the court. The court will generally discharge the bond by issuing an exoneration of bail order to the bonding company. only after the bonds company receives the bond exoneration will the collateral be returned.
